Scope

These terms apply when you buy the Instagram assistant, the management panel, installation or hosting, or custom software from the operator of AskThisAI ("AskThisAI", "we"). Every engagement is described in a written proposal. Where the proposal and these terms differ, the proposal prevails.

Proposals and acceptance

A proposal sets out the scope, deliverables, timeline, price, payment schedule and any service levels, and names both parties. A contract is formed when you accept the proposal in writing; an email is enough. Work starts after acceptance and, if the proposal says so, after an advance payment arrives.

Your responsibilities

• Give us accurate business information for the assistant to use, and tell us when it changes.
• Grant access to your Instagram professional account through Meta's tools. Do not share passwords with us.
• Keep the products, services and content the assistant describes lawful, and follow Meta's terms and policies.
• Name a person who handles the conversations the assistant hands over.
• Tell your own customers that an AI assistant answers them, and publish a privacy notice that covers it.

Our responsibilities

• Deliver what the proposal describes with reasonable skill and care.
• Keep your information confidential and use it only to provide the service.
• Tell you without delay about any incident that affects your data or the service.

Artificial intelligence

The assistant writes answers automatically. We limit it to the information you approve and review conversations with you, but AI can make mistakes. You remain responsible for commitments made to your customers; orders, refunds and complaints should be confirmed by a person.

Third-party platforms

The service depends on Meta, AI providers and hosting providers. We are not responsible for their outages or for changes to their products, prices or policies, including restrictions Meta places on an account because of its content or activity. If such a change needs work on our side, we tell you and agree the next step with you.

Fees and payment

Prices and payment terms are in the proposal. Unless it says otherwise, payment is due within 7 days of a payment request, and prices do not include taxes. If a payment is late, we may pause the service after giving you written notice.

Your customers' personal data

When the assistant handles your customers' messages, you are the data controller and we process that data on your behalf. We process it only on your instructions and to provide the service, keep it secure, use sub-processors (such as Meta, AI providers and hosting providers) bound by suitable terms, and help you answer your customers' requests. When the contract ends, we return or delete the data, as you choose.

Intellectual property

• The AskThisAI assistant, panel and our reusable components remain ours. You receive a licence to use them for as long as the contract runs.
• Custom software written only for you becomes yours once it is paid in full, unless the proposal says otherwise.
• Your content and data remain yours.

Fixes and support

We fix defects in what we delivered during the support period stated in the proposal. Support covers the agreed scope; new features are quoted separately.

Liability

Our total liability under a contract is limited to the fees you paid in the 12 months before the claim. We are not liable for lost profits or other indirect losses. These limits do not apply to intent, gross negligence or any liability the law does not allow us to limit.

Duration and ending a contract

Monthly services renew every month until either side cancels with 30 days' written notice. Either side may end a contract straight away if the other seriously breaches it and does not put it right within 14 days of being told. Fees for work already done remain payable.

Consumers

Our services are designed for businesses. If you buy as a consumer, your statutory rights apply. The right of withdrawal for a service ends once a service tailored to you has started with your approval, as the law allows.

Governing law and disputes

Contracts under these terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Türkiye have jurisdiction. If you are a consumer, this does not remove your right to apply to consumer arbitration committees or courts where you live.
